Guidelines on Making Offers on New Homes

Importance in Home Buyer Communication

Each home buyer should discuss the offer and negotiation process with their Help-U-Sell real estate broker during the initial counseling process and before any offer is presented. This will ensure that the homebuyer Buyer understands the process, the possibility of competing offers, and what the Seller's options are.

Real Estate Broker Advises and Homebuyer Decides

All decisions about how offers will be presented, negotiated and ultimately accepted, are made by the home Buyer and/or Seller, NOT the Help-U-Sell® real estate broker. Help-U-Sell real estate agents will communicate, advise and keep their respective client informed of all offer activities. They will NOT make the decisions. The homebuyer makes the decisions.

Home Offers Confidentiality

All offers and counter offers on new homes should be in writing to ensure that the terms, time frames and legal obligations of the parties are clearly understood and communicated without misunderstanding, withdrawals, counter offers and/or any changes to offers should be done in writing, signed and dated.

Existence of Home Offers

The terms of all home offers, counter offers, withdrawals and terminations may not be disclosed by Help-U-Sell® real estate agents without the prior consent of both the Buyer and Seller.

Existence Of Home Offers

The Seller decides whether the Seller and Broker is able to disclose that another competing offer has been received, contemplated, or is being negotiated. The home buyer's Broker will disclose this information to the Buyer if it is received. The Buyer is NOT entitled to this information without express permission from the Seller.

Full Price Home Offers

The Seller is NOT obligated to sell the property even if the Buyer makes a full price, contingency-free offer.

Priority Of Home Offers

The first or highest offer made does not bind or otherwise limit the Seller to act upon that offer before considering other offers. There is no priority of home offers. The Seller makes all decisions.

Real Estate Agents and Attorneys

Real estate agents are NOT Attorneys!   Real estate agents advise Buyers and Sellers to seek legal counsel from Attorneys regarding any question about the legal status of an offer, counter offer or contract.

0Broker Focus: Patrick Wood by HELPUSELL pats pr pics 003 300x225 Broker Focus: Patrick Wood Patrick Wood Anyone who has driven through Chino Hills, Calif., probably recognizes Patrick Wood’s name. He’s known for his ubiquitous signage. “The technique that brought me huge success in my core market was to start branding my name with the Help-U-Sell Office,” says Wood, who has owned Help-U-Sell Prestige Properties since 2003. All of his staff members have magnets on their cars that have his name and the Help-U-Sell Real Estate name, and his main work vehicle has a wrap that stands out. “The real estate signs and open house signs [also] have resulted in huge recognition, and the community has responded amazingly well,” he adds. “I constantly hear how people see my signs everywhere.” Of course, there is more to his success than signage. Wood, whose office has closed 54 sides so far this year, emphasizes the importance of offering full service and commission savings in attracting clients. “I found this to be necessary as other agents were trying to compete with my office by suggesting the clients would have to do all the work,” he says. “The full service leaves the client satisfied, which results in referrals, so it has been beneficial.” For new Help-U-Sell Brokers, he recommends continuing the full-service concept through to the office setup. “[In our office] a team concept has been put in place, and it provides clients with access to licensed assistants seven days a week,” he says. “Service is big, constant contact is big, working together is huge. This is a crazy, intense field and having the support of a team makes it much easier and productive.”
